המרחב האפור של ההתיישבות בשטחים נחשף במאמר זה במסגרת הגיאוגרפיה המשפטית. המאמר חותר לבחון את הזיקות בין התיישבות, שאיפות אתנו-לאומיות של שליטה בטריטוריה, חוק ולגיטימציה, תוך כדי התמקדות בשלוש טכנולוגיות של שליטה טריטוריאלית שיישמה מדינת ישראל בשטחים הפלסטיניים הכבושים: חוקי חירום, הטלאות של חוק ותכנון בלתי פורמלי. הטכנולוגיה האחרונה, שבה מתמקד המאמר, יושמה בהקמת המאחזים ובהליך הכשרתם המשפטית המתרחש בשנים האחרונות. המאחזים מתוארים כנקודת ציון ברצף המרחבי-משפטי של מפעל ההתנחלויות, ולא כחריג, החותר לקבל הכשר ממערכת המשפט. בחתירה זו נאלצת המערכת הפוליטית והמינהלית לאזן בין התביעות להכשרת המאחזים לבין דרישות שלטון החוק לפעול על פי חוק. במסגרת זו יש להגיע לפשרות עם מערכת המשפט, ובראשן הגנה מינימלית על זכויות קניין של בעלי קרקעות פלסטינים. השאיפות האתנו-לאומיות, התמיכה בהקמת המאחזים, ההתכתבות עם מערכת המשפט, פינוי והריסת מאחזים והניסיון להתמודד עם לחצים פנימיים ובין-לאומיים מתוארים במאמר כמהלך של קידוד המופעים המרחביים של החוק בצבעים דינמיים של אפור. קידוד כזה חותר תחת האבחנות המשפטיות הדיכוטומיות של חוק ופשע, ועל ידי כך מבסס מערך כלים חדש לבחינת הזיקות הרבות בין משפט ומרחב.

The Gray Space of Colonization: A Legal-Geography Analysis of the Outposts /

The gray space of colonization in the occupied Palestinian territories is explored in this article in terms of legal geography. The investigation aims to analyze the links between colonization, ethno-national ambitions for territorial control, law, and legitimacy by focusing on three technologies of territorial control: state of emergency, patching processes, and informal planning. The most recent technology, at the heart of the article, is implemented in the establishment and legalization of outposts. Thus, the outposts are described as a colonial practice located on the continuum of “formal” colonies in the occupied Palestinian territories that seek legitimacy. The quest for legitimacy obligates politicians and the state bureaucracy to compromise with the legal authorities, mainly through minimal protection of the property rights of Palestinian landowners. The dialogue with the legal authorities, the evacuation of outposts, the challenge of international condemnation, and the political demands are described in the article as encoding the spatial facades of law in different shades of gray. This encoding undermines the dichotomies between legality and illegality, and by exposing it, offers a new toolbox for analyzing the relations between law and space.
