המאמר מציג דיון ביקורתי בהתמודדות של פרופסיית הרפואה עם פשעי הרפואה של הנאצים, מתוך התמקדות בשיח ובפרקטיקה הביואתיים בארצות הברית, בישראל ובגרמניה. הבחירה במדינות אלו נועדה להביא את הפרספקטיבה של המנצחים, של המנוצחים ושל הקורבן, וכן לאפשר ראייה היסטורית של תהליכי בניית הדיסציפלינה החדשה.

המאמר בוחן את הרצף האפשרי שבין הרפואה הנאצית לבין הרפואה ה"נורמלית": האם, ועד כמה, התפתחה הביואתיקה (של הרפואה ה"נורמלית") מתוך הכרה ברצף זה או מתוך דחייתו? לטענת המחברים, במשך עשורים רבים לאחר מלחמת העולם השנייה הבחינה מרבית הפרופסיה הרפואית בין פשעי הרפואה של הנאצים לבין העשייה הרפואית שלה עצמה. הבחנה זו אפשרה לקהילת הרפואה להתעלם ממחקרים ומפרקטיקות רפואיים בעייתיים, כגון שימוש באוכלוסיות "שבויות" (כמו אסירים וחולי נפש) וטשטוש בין פעילות מחקרית לבין פעילות טיפולית. גם בשנות השישים, כאשר התעצמה הביקורת על הממסד הרפואי, הודחקו בדרך כלל הלקחים האפשריים מהפרקטיקות הרפואיות של תקופת הנאציזם.

המאמר נכתב מתוך תפיסה הקוראת להשתמש בתובנות של ניתוח היסטורי, על ההקשר החברתי, הכלכלי והפוליטי שלו, לצורך ניסוח שאלות אתיות המוצגות בדרך כלל באופן אוניברסלי פוזיטיביסטי. הבנת ההתפתחות של השיח הביואתי ויחסי הגומלין בינו לבין ההיסטוריה של הרפואה, שבכללה השפעתה של השואה והרפואה הנאצית, יכולה אפוא לפתוח צוהר להתבוננות רפלקסיבית בשיח הרפואי והביואתי בהווה.

Bioethics in the Shadow of the Holocaust: A Comparative Perspective / Rakefet Zalashik and Nadav Davidovitch

Our article analyzes from a critical perspective how the medical profession has responded to Nazi medical crimes. We focus on bioethics discourses and practices in the United States, Israel and Germany, thus presenting the perspectives of the victors, the victims and the defeated, while making possible a broader historical view of the construction of the emerging discipline of bioethics after World War II.

We investigate the possibility of a continuum between Nazi and “normal” medicine. That is, we consider whether bioethics developed after World War II from the recognition that there is a connection between Nazi medicine and medicine in general, or whether it developed from the universal rejection of such a connection. We argue that for many decades after World War II most of the medical profession differentiated between Nazi medical crimes and “normal” medical activities. This demarcation enabled the medical profession to ignore problematic medical practices, such as the use of captive populations (for example, prisoners or hospitalized mentally ill patients) in medical research, and to blur the distinction between research and clinical practices. Even when criticism was leveled at the medical profession by jurists and social scientists in the 1960s, the lessons that could have been drawn from Nazi medical practices were usually ignored.

Our article is based on the assumption that in order to better understand the construction of bioethics we need to broaden the common bioethical perspective, usually presented as universal and positivist, and base our analysis on historical, social, economic and political considerations. By understanding the development of the bioethics discourse and its relation to the history of medicine, including Nazi medicine, we can create an opportunity for a more reflective analysis of the discourses of both medicine and bioethics.

يعرض المقال نقاشًا نقديًا حول تعاطي مهنة الطب مع الإجرام الطبي للنازيّين وذلك عبر التركيز على الخطاب وسلوكيات الأخلاق الحيوية (Bioethics) في الولايات المتحدة وإسرائيل وألمانيا. إن اختيار هذه البلدان تحديدًا إنما جاء لتوضيح منظور المنتصرين والمهزومين والضحايا إضافة إلى توفير نظرة تاريخية على سيرورات تشكيل الحقل المعرفي (Discipline) الجديد.

يفحص المقال التسلسل الممكن الذي يربط بين الطب النازي وبين الطب "المعتاد": هل تطوّرت الأخلاق الحيوية (القائمة في الطب "المعتاد") استنادًا إلى الإدراك بهذا التسلسل أم عبر رفضه وإلى أي حد؟ يدعي الكاتبان بأن غالبية المهنيّين في مجال الطب قد فرضوا على مدار عقود طويلة بعد الحرب العالمية الثانية تمييزًا بين جرائم الطب النازي وبين العمل الطبي الذي أنتجه مجال الطب نفسه. منح هذا التمييز فئة العاملين في مجال الطب فرصة لتجاهل الأبحاث والممارسات الطبية الإشكالية، كاستخدام فئات سكانية "محتجزة" (مثل: السجناء والمرضى النفسانيّين)، وطمس التمييز بين أعمال بحثية وبين أعمال علاجية. كذلك في الستينيات، حين تعاظمت أصوات النقد على المؤسّسة الطبية، تمّ بصورة عامة تجاهل العبر الممكنة على صعيد الممارسات الطبية الخاصة بالحقبة النازية.

كُتب المقال انطلاقًا من مفهوم يدعو إلى استخدام أفكار التحليل التاريخي بسياقاته الاجتماعية والاقتصادية والسياسية بغية صياغة أسئلة أخلاقية تُعرض بصورة عامة بنبرة عالمية انطلاقًا من الفلسفة الوضعية. ولذلك فإن فهم تطوّر خطاب الأخلاق الحيوية والعلاقات المتبادلة بينه وبين تاريخ الطب، ومن ضمن ذلك تأثير المحرقة والطب النازي، من شأنه أن يفتح أمامنا نافذة للتفكّر الانعكاسي في الخطاب الطبي والأخلاق الحيوية في الوقت الراهن.
